Michael Lotito

Michael J. Lotito is a Partner at Jackson Lewis LLP.  He is one of the nation’s leading authorities on preventive strategies in the workplace.  Mr. Lotito has served as lead counsel for some of the country’s largest corporations, developing strategic solutions to labor and employment issues and helping them effectively implement business, legal, and preventive strategies.

Mr. Lotito has spoken about workplace issues throughout the world, including locations such as Germany, Taiwan, South Africa, and virtually every state in the United States before a wide variety of audiences.  He is regularly interviewed by the national news media regarding workplace and labor law issues and events.  He has appeared on PBS’s “NewsHour with Jim Lehrer,” FOX News, and is frequently heard on National Public Radio.  He has been quoted in The New York Times, Wall Street Journal, Forbes, BusinessWeek, Washington Post, Boston Globe, USA Today, Los Angeles Times, San Francisco Chronicle, Sacramento Bee, Houston Chronicle, National Law Journal, Nation’s Business, Harvard Business Review, and other major publications.

Most recently, Mr. Lotito has been speaking out as an adamant opponent of the Employee Free Choice Act (“EFCA”), which he believes would harm employees and employers alike by depriving employees of the chance to make a considered choice on union representation.  Zealously expressing his concerns, Mr. Lotito has co-authored EFCA-related articles and opinion pieces published in Employment Law 360 and Chain Store Age; another EFCA article co-authored by Mr. Lotito will soon be published in Directorship Magazine.  Mr. Lotito also recently appeared on FOX Business News, where he discussed the repercussions of EFCA legislation.  He has been featured as a special guest, along with George McGovern, on a CBS radio program on the topic of EFCA, hosted by Jackson Lewis Partner Martin F. Payson.  Because of his expertise and reputation as an expert on EFCA legislation, Mr. Lotito has been interviewed by a number of sources and was recently quoted in an EFCA article in Business Week; he has been quoted in HR Executive Magazine

Mr. Lotito has also authored articles for respected publications, including HR Magazine, Human Resources Executive, and The Journal of the Association of Corporate Counsel ACC Docket.  He has co-authored several books, including: “The Americans with Disabilities Act;” “What Managers & Supervisors Need to Know About the ADA;” “Making the ADA Work for You;” and “Minding Your Business: Legal Issues and Practical Answers for Managing Workplace Privacy.”

Mr. Lotito received his bachelor’s (1970) and law degree (1974) from Villanova University.  He is a member of the California Bar Association and an American Bar Association fellow.  He has received lifetime Society of Human Resource Professionals (SPHR) certification, chaired the 225,000-member Society of Human Resource Management (SHRM), was chairman of SHRM’s National Legislative Affairs Committee, and served on its Employee and Labor Relations Committee.  He has testified before the U.S. Senate and House of Representatives as well as the EEOC.  In 1988, he was honored as member of Vistage 200, a designation that places him among the top one percent of all Vistage presenters in the world. (Vistage is the world’s largest CEO member organization.) Lotito is also listed in Who’s Who in American Law -- The International Book.  The Villanova University’s Graduate Program in Human Resources named him the Top Human Resources Alumnus of the 20th Century.
